A Home Movie for Zachary: The Andrew Bagby Case

Andrew Bagby grew up starring in his best friend's homemade movies in California, and by 2001 he was a family medicine resident in Latrobe, Pennsylvania. One November morning, a man picking up cans in Keystone State Park found him face down on the gravel. Police zeroed in on a fellow doctor Andrew had broken up with a few days earlier, and within a couple of weeks she was back home in Newfoundland, pregnant with Andrew's baby. Andrew's parents, David and Kate, packed up and moved across the continent to be near their grandson, Zachary, while the murder case crawled through 2 countries. Andrew's oldest friend, Kurt Kuenne, started making a movie so Zachary could get to know his dad. This is the story behind the documentary Dear Zachary, told in order from the beginning.

[MUSIC]

2
00:00:04,660 --> 00:00:10,580
A man picking up aluminum cans in a state park in Southwest Pennsylvania found a young doctor lying

3
00:00:10,580 --> 00:00:13,760
face down on the gravel near his car.

4
00:00:13,760 --> 00:00:16,080
There was a thin layer of frost on him.

5
00:00:16,080 --> 00:00:17,960
He was 28 years old.

6
00:00:17,960 --> 00:00:23,920
His name was Andrew Bagby and he'd spent years starring in his best friends homemade movies.

7
00:00:23,920 --> 00:00:27,000
Andrew's story starts with a book report.

8
00:00:27,000 --> 00:00:37,000
[MUSIC]

9
00:00:37,000 --> 00:01:03,600
Andrew Bagby grew up in the suburbs of San Jose, California.

10
00:01:03,600 --> 00:01:08,200
And in the first grade, he met a kid named Kurt Keeney, who talked the teacher into letting

11
00:01:08,200 --> 00:01:13,760
him hand in a screenplay for his book report, which is a bold move for a first grader.

12
00:01:13,760 --> 00:01:17,000
And then he cast Andrew as one of the stars.

13
00:01:17,000 --> 00:01:19,880
Kurt kept making movies all through school.

14
00:01:19,880 --> 00:01:24,680
And once they looked professional, Andrew put some of his med school savings into those

15
00:01:24,680 --> 00:01:25,680
movies.

16
00:01:25,680 --> 00:01:27,840
That's a really good friend.

17
00:01:27,840 --> 00:01:30,920
Andrew was David and Kate Bagby's only kid.

18
00:01:30,920 --> 00:01:36,000
And his friends said that he was warm and that he had more friends than most people have.

19
00:01:36,000 --> 00:01:40,280
He went to medical school at Memorial University in St. John's, Newfoundland.

20
00:01:40,280 --> 00:01:43,560
You have to go way out into the North Atlantic to find it.

21
00:01:43,560 --> 00:01:47,680
And that's where Andrew met a doctor named Shirley Turner.

22
00:01:47,680 --> 00:01:50,100
Shirley was 12 years older than Andrew.

23
00:01:50,100 --> 00:01:52,480
She grew up poor and moved around a lot.

24
00:01:52,480 --> 00:01:56,120
She got pregnant in college and married the baby's dad.

25
00:01:56,120 --> 00:02:00,520
After that, she spent years teaching science and chipping away at school until she got

26
00:02:00,520 --> 00:02:05,240
herself into medical school too, which took her well into her 30s.

27
00:02:05,240 --> 00:02:10,240
If you pull her social services records, there's a file from 1993.

28
00:02:10,240 --> 00:02:14,520
Somebody reported she'd been hitting kids and being verbally abusive.

29
00:02:14,520 --> 00:02:17,680
That she left a child without enough supervision.

30
00:02:17,680 --> 00:02:22,280
The caseworkers left her some messages and closed the file without ever even talking to

31
00:02:22,280 --> 00:02:23,280
her.

32
00:02:23,280 --> 00:02:24,840
That was the whole investigation.

33
00:02:24,840 --> 00:02:29,680
An ex-boyfriend, back in Pennsylvania, told the inquiry that she kept calling him and

34
00:02:29,680 --> 00:02:32,120
showing up at his house uninvited.

35
00:02:32,120 --> 00:02:37,200
And he said that she hit him with a platform shoe and threatened to slit his throat.

36
00:02:37,200 --> 00:02:40,640
Andrew and Shirley got together in 1999.

37
00:02:40,640 --> 00:02:45,440
Andrew went back to the states for residency and ended up in family medicine at the Trobe

38
00:02:45,440 --> 00:02:50,640
Area Hospital in Pennsylvania, while Shirley landed a doctor job out in the Midwest.

39
00:02:50,640 --> 00:02:56,360
And the whole thing turned into this long-distance mess full of fights about other people and

40
00:02:56,360 --> 00:02:58,240
where it was all headed.

41
00:02:58,240 --> 00:03:01,880
In Iowa, Shirley walked out on a 10-year contract.

42
00:03:01,880 --> 00:03:08,720
If you break a deal like that early, you owe them and she owed more than $156,000.

43
00:03:08,720 --> 00:03:12,360
In October of 2001, she got a gun permit.

44
00:03:12,360 --> 00:03:16,840
She bought a Phoenix Arms 22 pistol and took shooting lessons.

45
00:03:16,840 --> 00:03:21,400
And the last lesson was right before she left to go see Andrew in Pennsylvania.

46
00:03:21,400 --> 00:03:25,760
That visit ended at the Latrobe Airport, where Andrew broke up with her after a fight

47
00:03:25,760 --> 00:03:27,640
about him seeing other women.

48
00:03:27,640 --> 00:03:30,000
Shirley went back home to council bluffs Iowa.

49
00:03:30,000 --> 00:03:34,160
The next day, she got into her car and drove back toward Andrew.

50
00:03:34,160 --> 00:03:38,440
And if you map that drive, it's about 946 miles.

51
00:03:38,440 --> 00:03:43,120
Shirley turned up at Andrew's place early that morning and Andrew told a supervisor that

52
00:03:43,120 --> 00:03:45,280
she seemed very angry.

53
00:03:45,280 --> 00:03:49,600
She picked up Andrew's home phone and called in sick to her own job.

54
00:03:49,600 --> 00:03:51,160
That was a bad idea.

55
00:03:51,160 --> 00:03:57,480
She also got on his computer and used his internet and at some point that day, somebody saw her car

56
00:03:57,480 --> 00:04:02,800
and Andrew's car sitting together at Keystone State Park, which is a state park outside of

57
00:04:02,800 --> 00:04:03,960
the Latrobe.

58
00:04:03,960 --> 00:04:08,880
The next morning, the man picking up cans found Andrew near his car.

59
00:04:08,880 --> 00:04:13,280
The autopsy showed he'd been shot five times and hit in the back of the head.

60
00:04:13,280 --> 00:04:16,280
The bullets were 22 caliber.

61
00:04:16,280 --> 00:04:18,480
Nobody ever found the gun.

62
00:04:18,480 --> 00:04:21,200
Shirley's explanations kept moving around.

63
00:04:21,200 --> 00:04:24,400
In one version, she never even left Iowa.

64
00:04:24,400 --> 00:04:26,800
In another, she met Andrew at the park.

65
00:04:26,800 --> 00:04:31,520
She said the gun got stolen and she said she'd also given it to Andrew.

66
00:04:31,520 --> 00:04:35,440
If you line them up, that's four different stories that Shirley was telling.

67
00:04:35,440 --> 00:04:41,520
A week later, Shirley left Iowa and on November 16, she was back home in Newfoundland.

68
00:04:41,520 --> 00:04:46,040
She was pregnant and the ultrasound listed Andrew as the dad.

69
00:04:46,040 --> 00:04:50,320
Pennsylvania charged her with murder and now you've got a murder suspect sitting in another

70
00:04:50,320 --> 00:04:55,680
country, which means extradition, with formal requests and paperwork going back and forth

71
00:04:55,680 --> 00:04:58,520
between governments for as long as it takes.

72
00:04:58,520 --> 00:05:04,520
The police in Newfoundland arrested her on December 12 and she was back out the same day.

73
00:05:04,520 --> 00:05:11,120
Her psychiatrist, Dr. John Dussette, walked into the courthouse and put up $65,000 as surety,

74
00:05:11,120 --> 00:05:14,160
which means if she skipped town, he would lose that money.

75
00:05:14,160 --> 00:05:17,080
He'd been treating her for about three weeks.

76
00:05:17,080 --> 00:05:21,120
And let me repeat that part because it is just as weird as it sounds.

77
00:05:21,120 --> 00:05:27,520
Her psychiatrist, who has been treating her for three weeks now, put up $65,000 to get

78
00:05:27,520 --> 00:05:28,920
her out of jail.

79
00:05:28,920 --> 00:05:33,360
And that's a huge favor for someone that you've known for such a short amount of time.

80
00:05:33,360 --> 00:05:36,080
It doesn't seem exactly platonic.

81
00:05:36,080 --> 00:05:40,400
Back in California, Kate said that she used to go out her front door and say, "I'm Kate

82
00:05:40,400 --> 00:05:41,400
Bagby.

83
00:05:41,400 --> 00:05:43,000
I live in Sunnyvale, California.

84
00:05:43,000 --> 00:05:44,720
This did not happen to me.

85
00:05:44,720 --> 00:05:48,680
She was having a hard time processing the reality of the situation."

86
00:05:48,680 --> 00:05:54,520
Then, she found out that Shirley was carrying Andrew's baby and they packed up and moved across

87
00:05:54,520 --> 00:05:57,080
the continent to St. John's.

88
00:05:57,080 --> 00:06:01,680
Zachary Andrew Turner was born there on July 18, 2002.

89
00:06:01,680 --> 00:06:08,680
A DNA test put the odds that Andrew was his father at 99.9941%.

90
00:06:08,680 --> 00:06:13,600
If David and Kate wanted to see their grandson, they had to stay on Shirley's good side, which

91
00:06:13,600 --> 00:06:18,200
means you're sitting across from the woman that you believe killed your son and you have

92
00:06:18,200 --> 00:06:23,040
to be polite to her because she's the only way that you get to see this baby.

93
00:06:23,040 --> 00:06:25,360
They started with supervised visits.

94
00:06:25,360 --> 00:06:30,840
Kurt had been making a tribute movie about Andrew and once he heard about the baby, it turned

95
00:06:30,840 --> 00:06:33,360
into a letter to Zachary.

96
00:06:33,360 --> 00:06:35,520
Shirley went to jail that November.

97
00:06:35,520 --> 00:06:38,400
David and Kate took Zachary in full time.

98
00:06:38,400 --> 00:06:43,000
They drive him about 112 miles each way so that he could see his mom.

99
00:06:43,000 --> 00:06:48,600
The review called their child care exemplary, which is review language for they did everything

100
00:06:48,600 --> 00:06:49,600
right.

101
00:06:49,600 --> 00:06:54,480
In Appeals Court, let Shirley out in January while she appealed her conviction.

102
00:06:54,480 --> 00:06:59,320
Since she'd followed all of her conditions and under a consent order, Zachary went back

103
00:06:59,320 --> 00:07:04,120
into living with her while David and Kate got loads of time with him still.

104
00:07:04,120 --> 00:07:07,520
Kurt came out for Zachary's first birthday that July.

105
00:07:07,520 --> 00:07:12,480
And if Shirley was anywhere around, you wouldn't see Kurt because he'd hide so she'd never

106
00:07:12,480 --> 00:07:14,600
find out that he was there.

107
00:07:14,600 --> 00:07:18,320
People at the party remembered Zachary sticking close to David and Kate.

108
00:07:18,320 --> 00:07:23,240
And Shirley said something like "he loved them more and that they should take him."

109
00:07:23,240 --> 00:07:25,400
Nobody knows what she meant by that.

110
00:07:25,400 --> 00:07:27,200
Well not exactly.

111
00:07:27,200 --> 00:07:31,920
Shirley and Zachary went swimming with David and Kate on August 16th and nothing seemed

112
00:07:31,920 --> 00:07:33,360
off to them.

113
00:07:33,360 --> 00:07:39,160
The next day Shirley talked with friends, ran errands, made phone calls and wrote letters.

114
00:07:39,160 --> 00:07:42,720
She also filled a prescription for Laraza Pam.

115
00:07:42,720 --> 00:07:45,880
Several people who saw her said that she seemed ordinary.

116
00:07:45,880 --> 00:07:51,280
And at some point after that she took Zachary out to Fox trap Marina on Conception Bay where

117
00:07:51,280 --> 00:07:55,000
people saw her asking for directions and walking near the water.

118
00:07:55,000 --> 00:08:00,240
The investigation found that she probably gave Laraza Pam to Zachary and then she went

119
00:08:00,240 --> 00:08:02,040
into the water holding him.

120
00:08:02,040 --> 00:08:06,040
They both died August 18th 2003.

121
00:08:06,040 --> 00:08:08,080
Zachary was 13 months old.

122
00:08:08,080 --> 00:08:09,880
Shirley was 42.

123
00:08:09,880 --> 00:08:14,400
Zachary's blood had about 100 times the normal medical level of Laraza Pam.

124
00:08:14,400 --> 00:08:19,480
The medical examiner ruled Zachary's death a homicide and Shirley's a suicide.

125
00:08:19,480 --> 00:08:22,720
There was also a baby bottle with liquid left in it.

126
00:08:22,720 --> 00:08:26,960
Somebody poured it all out before anybody tested it so it will never know what was in that

127
00:08:26,960 --> 00:08:28,280
bottle.

128
00:08:28,280 --> 00:08:32,120
The investigation went through about 100,000 pages of documents.

129
00:08:32,120 --> 00:08:37,680
The report came out in 2006 and said Zachary's death could have been prevented.

130
00:08:37,680 --> 00:08:40,520
You had police holding a piece of Shirley's history.

131
00:08:40,520 --> 00:08:43,840
The courts had a piece or doctors had a piece.

132
00:08:43,840 --> 00:08:45,600
Child welfare had a piece.

133
00:08:45,600 --> 00:08:50,160
Everybody was so focused on Shirley's rights that nobody ever sat down and looked at Zachary

134
00:08:50,160 --> 00:08:52,640
safety all by itself.

135
00:08:52,640 --> 00:08:56,360
The investigation found that 1993 file 2.

136
00:08:56,360 --> 00:09:01,160
When Shirley came back into the system, she had a different last name and nobody was required

137
00:09:01,160 --> 00:09:05,120
to write down old names so the file never came up.

138
00:09:05,120 --> 00:09:06,640
It was right there.

139
00:09:06,640 --> 00:09:12,040
The medical board found John the psychiatrist guilty of misconduct over that money.

140
00:09:12,040 --> 00:09:18,600
They ordered him to pay $10,000 and they also ordered the psychiatrist to go see a psychiatrist.

141
00:09:18,600 --> 00:09:24,800
Kurt finished his movie in 2008 and he called it "Dear Zachary", a letter to a son about

142
00:09:24,800 --> 00:09:25,800
his father.

143
00:09:25,800 --> 00:09:29,800
He got screened for members of Parliament in Ottawa which means the kid who handed in a

144
00:09:29,800 --> 00:09:35,280
screenplay for his first grade book report now had a movie in front of the people who make

145
00:09:35,280 --> 00:09:36,840
Canada's laws.

146
00:09:36,840 --> 00:09:42,680
A member of Parliament brought it in Bill C-464 and everyone started calling it Zachary's

147
00:09:42,680 --> 00:09:43,680
Bill.

148
00:09:43,680 --> 00:09:46,880
It became law on December 15, 2010.

149
00:09:46,880 --> 00:09:51,840
In Canada, if you're a judge now, you can keep somebody locked up before trial when that's

150
00:09:51,840 --> 00:09:55,120
needed to protect any kid under 18.

151
00:09:55,120 --> 00:10:00,240
David and Kate put up Christmas decorations that year for the first time in years.

152
00:10:00,240 --> 00:10:02,240
Shirley never went to trial.

153
00:10:02,240 --> 00:10:05,720
The review decided she was probably the one who killed Andrew.

154
00:10:05,720 --> 00:10:10,200
When the province checked in 2014, most of the reviews recommendations had been put in

155
00:10:10,200 --> 00:10:12,240
place in one form or another.

156
00:10:12,240 --> 00:10:17,120
Although a couple were still only partway done and some of them didn't apply anymore, nearly

157
00:10:17,120 --> 00:10:22,160
four dozen medical students going into family medicine have gotten a scholarship in Andrew's

158
00:10:22,160 --> 00:10:33,200
name at the hospital in La Trope.

159
00:10:33,200 --> 00:10:37,160
Thanks for listening to 10 Minute Murder, bingeable true crime stories.

160
00:10:37,160 --> 00:10:40,800
Hello, I'm Joe, I'm the host and here's an email.

161
00:10:40,800 --> 00:10:43,200
I used to work dispatch.

162
00:10:43,200 --> 00:10:49,280
Joe, six years on the radio quit in 2017 and I still can't hear a certain tone in somebody's

163
00:10:49,280 --> 00:10:51,960
voice without my shoulders going up.

164
00:10:51,960 --> 00:10:57,000
Most of what I took calls for was nothing, alarms going off because cats, guys who wanted

165
00:10:57,000 --> 00:10:59,120
their neighbors' dog dealt with.

166
00:10:59,120 --> 00:11:03,240
Then once in a while you'd get a call where you knew in the first three seconds.

167
00:11:03,240 --> 00:11:07,040
And the training was supposed to keep you steady, but the training doesn't do much about

168
00:11:07,040 --> 00:11:09,040
trying to sleep the next night.

169
00:11:09,040 --> 00:11:13,160
I listened to your show now, which might therapist as opinions about.

170
00:11:13,160 --> 00:11:14,880
Here's what I wanted to say.

171
00:11:14,880 --> 00:11:18,560
You read 911 transcripts like they should be read.

172
00:11:18,560 --> 00:11:19,560
Flat.

173
00:11:19,560 --> 00:11:22,720
You don't do the thing where somebody performs the fear.

174
00:11:22,720 --> 00:11:24,360
That matters more than you'd think.

175
00:11:24,360 --> 00:11:29,680
When people dramatize those calls, it turns a real worst moment into a bit.

176
00:11:29,680 --> 00:11:31,720
Keep doing it the way you're doing it.

177
00:11:31,720 --> 00:11:33,720
Charlene and Indiana.

178
00:11:33,720 --> 00:11:36,840
Charlene, thank you for taking the time to send me that message.

179
00:11:36,840 --> 00:11:41,920
And also, thank you for listening to the podcast, despite what your therapist is telling you.

180
00:11:41,920 --> 00:11:45,080
JK, you should probably listen to your therapist.

181
00:11:45,080 --> 00:11:49,160
But yeah, I've often thought that's one job I could never do.

182
00:11:49,160 --> 00:11:51,160
A 911 dispatcher?

183
00:11:51,160 --> 00:11:56,880
I research these cases and a lot of times I listen to the 911 calls of these cases.

184
00:11:56,880 --> 00:12:00,240
That's where some of the information comes from and what Charlene is talking about where

185
00:12:00,240 --> 00:12:03,280
I read the transcripts from these 911 calls.

186
00:12:03,280 --> 00:12:08,040
To do that, I have to listen to the call and they are traumatizing.

187
00:12:08,040 --> 00:12:10,000
You hear the fear in people's voices.

188
00:12:10,000 --> 00:12:11,840
You can hear the pain.

189
00:12:11,840 --> 00:12:17,400
And if it's a killer that's calling, you can hear the coldness sometimes in their phone call.

190
00:12:17,400 --> 00:12:22,560
And after the few minutes of whatever call that's on, the 911 dispatcher disconnects with

191
00:12:22,560 --> 00:12:27,240
the call and then moves on with the rest of their day, I suppose.

192
00:12:27,240 --> 00:12:30,640
Goes to the break room and eats up some ravioli for dinner.

193
00:12:30,640 --> 00:12:35,880
I don't know, that's not a job that I could ever see myself, I even attempting to do.

194
00:12:35,880 --> 00:12:38,920
I can't compartmentalize things like that.

195
00:12:38,920 --> 00:12:42,840
The way that I suppose that you have to and stay sane doing that job.

196
00:12:42,840 --> 00:12:46,760
All day long, you're just dealing with people's worst moments of their life.

197
00:12:46,760 --> 00:12:50,160
And you clock out and you come back the next day and you do it again.

198
00:12:50,160 --> 00:12:51,160
And again.

199
00:12:51,160 --> 00:12:52,160
And again.

200
00:12:52,160 --> 00:12:53,160
No thank you.

201
00:12:53,160 --> 00:12:55,320
My hat's off to those of you that can do that.

202
00:12:55,320 --> 00:12:59,480
